Welcome to Demon Resell (“Demon Resell“, “we“, “us“, or “our“). These Terms and Conditions (“Terms“) govern your access to and use of the website located at https://demonresell.com and any related services, features, content, and applications (collectively, the “Service“). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About Demon Resell

Demon Resell operates an online marketplace that allows independent third-party sellers (“Sellers“) to list, sell, and ship new and pre-owned items to buyers (“Buyers“). Demon Resell is not the seller of items listed by third parties. We provide the platform; the contract of sale for any item is directly between the Buyer and the Seller.

2. Eligibility

To use the Service you must:

  • be at least 18 years old, or the age of majority in your jurisdiction;

We may refuse service, close accounts, or cancel listings at our discretion.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [support@demonresell.com] of any unauthorized use. We are not liable for loss or damage arising from your failure to protect your credentials.

4. Listings, Purchases, and Sales

4.1 Buyers. When you place an order, you make a binding offer to purchase the item from the Seller on the terms shown in the listing. The Seller may accept or decline. Payment is processed at checkout; funds may be held until the transaction is complete.

4.2 Sellers. Sellers are solely responsible for the accuracy of their listings, including the item’s title, description, condition, images, price, shipping terms, and legal right to sell. Sellers must:

  • accurately grade item condition using our condition categories (New, Like New, Used – Good, Used – Fair, For Parts);
  • disclose defects, missing components, and any material issues;
  • ship promptly and in accordance with the listing;
  • comply with all applicable laws, including tax, consumer protection, import/export, and product safety laws.

4.3 Prohibited items. You may not list, sell, or attempt to buy: counterfeit or replica goods; stolen property; recalled products; hazardous materials; weapons and ammunition where prohibited; illegal drugs, drug paraphernalia, or tobacco where prohibited; adult content; human remains or body parts; live animals; items that infringe intellectual property; or anything unlawful in the Buyer’s or Seller’s jurisdiction. We may remove any listing at any time, with or without notice.

4.4 Fees. Demon Resell may charge Sellers listing fees, final-value fees, payment processing fees, and other fees as published on our fees page. All fees are non-refundable unless stated otherwise.

4.5 Taxes. You are responsible for determining and paying any taxes (sales, VAT, GST, income, customs, etc.) that apply to your transactions.

5. Shipping, Returns, and Disputes

5.1 Shipping. Sellers are responsible for packaging and shipping items within the timeframe stated in the listing. Risk of loss transfers to the Buyer upon delivery, unless the Seller’s policy states otherwise.

5.2 Returns. Each Seller sets their own return policy, which must be shown on the listing. Where required by law (for example, EU/UK consumer rights of withdrawal), statutory return rights apply regardless of the Seller’s stated policy.

5.3 Buyer protection / disputes. If an item does not arrive or is materially not as described, contact the Seller first. If unresolved, you may open a case in our Resolution Center within [X] days of the estimated delivery date. Demon Resell may, in its discretion, mediate disputes, issue refunds from held funds, and reverse payouts. Our decisions are final for platform purposes and do not limit any rights you may have under applicable law.

6. Payments

Payments are processed by third-party payment providers (e.g., [Stripe / PayPal / others]). By using the Service you also agree to those providers’ terms. Demon Resell does not store full payment card numbers. Payouts to Sellers are made on the schedule and by the method described in the Seller Center, subject to holds for risk, chargebacks, or open disputes.

7. User Content

You retain ownership of the text, images, and other content you submit (“User Content“). You grant Demon Resell a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, modify (for formatting), publish, and display User Content for the purpose of operating and promoting the Service. You represent that you own or have the necessary rights to your User Content and that it does not violate any law or third-party right.

8. Prohibited Conduct

You agree not to:

  • use the Service for any unlawful, fraudulent, or deceptive purpose;
  • circumvent fees or complete transactions outside the platform to avoid fees;
  • manipulate prices, reviews, ratings, or search results;
  • scrape, crawl, or use automated tools to access the Service except through published APIs;
  • upload malware, engage in denial-of-service activity, or interfere with the Service;
  • harass, abuse, or threaten other users; or
  • impersonate any person or misrepresent your affiliation.

9. Intellectual Property

The Service, including its software, design, logos (“Demon Resell”, the Demon Resell mark and stylised logo), and content we create, is owned by Demon Resell or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission, except as expressly allowed by these Terms.

If you believe content on the Service infringes your copyright, send a notice to [support@demonresell.com] including the information required under the DMCA (17 U.S.C. § 512) or your local equivalent.

10. Suspension and Termination

We may suspend or terminate your account, remove listings, withhold payouts, or restrict access at any time if we believe you have violated these Terms, created risk or legal exposure for Demon Resell, or engaged in fraudulent or harmful conduct. You may close your account at any time; obligations arising before closure survive.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Demon Resell does not warrant that the Service will be uninterrupted, error-free, or secure, and does not guarantee the quality, safety, legality, or accuracy of items listed by Sellers. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions our liability is limited to the extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, Demon Resell and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service. Our aggregate liability for any claim arising from or related to the Service will not exceed the greater of (a) the fees you paid to Demon Resell in the twelve months before the event giving rise to the claim, or (b) USD 100.

13. Indemnification

You agree to indemnify and hold harmless Demon Resell from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your use of the Service, your User Content, your transactions with other users, or your breach of these Terms or applicable law.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of [State/Country], without regard to conflict-of-law rules.
